Terms of Service

1. Acceptance of these Terms
These Terms of Service (the “Terms”) form a binding agreement between you and Indilingo Labs (“Indilingo,” “we,” “us,” or “our”) and govern your access to and use of Indilingo Voice, including our website, phone-call sessions, and related services (together, the “Service”).
By signing up for, requesting a call from, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract to use the Service. If you use the Service on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf.
3. The Service
Indilingo Voice is a language-practice service that places voice phone calls during which you can practice speaking a language with an automated, artificial-intelligence-powered conversational tutor. The Service is provided for educational and personal-enrichment purposes.
The Service is a conversational practice tool. It is not a substitute for accredited instruction, certification, or examination, and we make no guarantee regarding any particular learning outcome, proficiency level, or result.
4. Service availability
The Service may contain bugs, and may change, be interrupted, or be discontinued at any time without notice, and may not be available in all regions or languages. Features, limits, and pricing may change as the Service develops. The Service is provided on an “as is” and “as available” basis.
5. Your information
To use the Service you provide certain details, such as your name, email address, phone number, and language preference. You agree that this information is accurate, current, and complete, and that you will keep it up to date. You are responsible for activity that occurs through your use of the Service.
6. Consent to receive calls
The Service works by placing outbound voice calls to the phone number you provide. By submitting your phone number and requesting a call, you expressly authorize Indilingo and its telephony providers to place automated and artificial-intelligence-driven voice calls to that number for the purpose of delivering the Service.
You represent and warrant that you are the owner of, or are authorized to receive calls on, the number you provide. Standard call, data, or carrier charges may apply depending on your phone plan, and you are responsible for those charges. You are responsible for ensuring that receiving these calls is permitted under the laws applicable to you.
You may withdraw your consent and stop receiving calls at any time by contacting us at contact@indilingo.in or by following the opt-out instructions provided to you.
7. Call recording, transcription, and processing
To operate, secure, and improve the Service, calls may be recorded, transcribed, and processed by automated systems. By using the Service, you consent to the recording and transcription of your calls and your voice.
If any other person may be heard on or participates in a call, you are responsible for informing them that the call may be recorded and transcribed and for obtaining any consent required under the laws that apply to you and to them. Do not use the Service to record any person without the consent required by applicable law.
8. AI-generated content
Conversations and responses during a call are generated automatically and in real time. They may at times be inaccurate, incomplete, outdated, or otherwise inappropriate, and should not be relied upon as professional, medical, legal, financial, or other expert advice. You are responsible for using your own judgment when acting on anything said during a call.
9. Acceptable use
You agree that you will not, and will not attempt to:
- use the Service for any unlawful, fraudulent, harmful, or abusive purpose;
- harass, threaten, or abuse the service or use it to generate hateful, harassing, sexually exploitative, or otherwise harmful content;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its underlying systems;
- probe for, reverse engineer, or attempt to extract the underlying models, prompts, or technology that power the Service;
- resell, sublicense, or commercially exploit the Service without our written permission; or
- use automated means to abuse free trials, minute allowances, or promotional offers.
We may suspend or terminate access that we reasonably believe violates these rules.
10. Plans, minutes, and billing
Paid plans provide a monthly allowance of call minutes. Unless stated otherwise:
- minute allowances reset at the start of each billing cycle and do not roll over; unused minutes expire at the end of the cycle;
- subscriptions are billed in advance and renew automatically each month until cancelled;
- additional minute top-up packs may be purchased and are consumed according to their stated terms;
- prices are shown in the currency displayed at checkout and are exclusive of any applicable taxes, which may be added; and
- payments are processed by a third-party payment provider, and you agree to their terms when you pay.
11. Free trial
We may offer a one-time free trial call per user or phone number. We may determine eligibility for trials in our discretion and may modify or withdraw trial offers at any time. Abuse of trial offers may result in suspension.
12. Cancellation and refunds
You may cancel your subscription at any time; cancellation takes effect at the end of your current billing cycle, and you retain access until then. Except where required by applicable law, payments are non-refundable, and we do not provide refunds or credits for partial billing periods, unused minutes, or expired allowances.
13. Changes to plans and pricing
We may introduce, change, or discontinue plans, features, minute allowances, and prices. Where a change affects an active subscription, we will provide reasonable notice. Continued use of the Service after a change takes effect constitutes acceptance of the updated terms.
14. Intellectual property
The Service, including its software, voice technology, content, design, and the Indilingo and Indilingo Voice names and logos, is owned by Indilingo and its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial language practice, subject to these Terms.
15. Third-party services
The Service relies on third-party providers, including telecommunications carriers and payment processors. Their networks and services are outside our control, and we are not responsible for delays, failures, charges, or issues arising from them. Your use of those services may be subject to their own terms.
16. Privacy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you acknowledge that information will be handled as described there.
17. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will achieve any particular learning result.
18. Limitation of liability
To the maximum extent permitted by law, Indilingo and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to us for the Service in the twelve months before the event giving rise to the claim, or fifty United States dollars (US$50).
19. Indemnification
You agree to indemnify and hold harmless Indilingo and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party, including any failure to obtain a required consent to record a call.
20. Suspension and termination
We may suspend or terminate your access to the Service at any time if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. You may stop using the Service at any time. Terms that by their nature should survive termination will survive.
21. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
22. Governing law
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Subject to any rights you may have under mandatory local law, you agree that the courts located in India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
